Filing for lemon law, looking for advice or experience

So my 17 pacifica has had multiple minior issues I have been dealing with, but the biggest and scariest issue was on Aug 2nd when the start stop function disabled while driving 30MPH in traffic and it turned the vehicle completely off and came to an abrupt stop. Luckily the person behind me was paying attention and not on their phone like many drivers are now adays and I wasn't rear ended with my children in the vehicle. I was told to take it to the dealer and was finally able to do so Aug 7th. The battery died and was told the shifter was the problem and it needed to be replaced. Week after week was told it would be in the following week and after 30 days still no shifter. I contacted Chrysler to request a buy back because I honestly didn't even feel safe with the vehicle and it was still at the dealership waiting on the part. We finally recieved a call from a Chrysler rep saying the part was special handle ordered and should be there soon, I said I understand, however I still want to request a buy back and could because it was over 30 days nonoperable and qualified for lemon law. I have only heard from the rep once in a two week period stating that the part would finally be there within a day or two and said she was waiting for Chrysler to respond to our request. Now the shifter has been installed but the battery was dead again and they had to order another and another two days later, it isn't the battery but the start stop function isn't working and so they have to wait for their diagnostic specialist to figure out why this has now malfunctioned and of course the van will be there for longer. I started the process requesting a buy back over 2 1/2 weeks ago and my question is, obviously my van is a lemon law and this process shouldn't be a difficult one, but how long does this process take? Am I better off getting an attorney and having them deal with the process or should I keep waiting for someone to finally get back to me about the situation? Has anyone been through this and can provide info on how long it takes? We are approaching 2 months now of our vehicle being at the dealership. The service department there has been amazing and very communicative with me, however the FCA department is lacking bad with communication. I know that the process for determining the buyback of our vehicle could take a few days to maybe a few weeks but how long do they actually need to determine it? ANy information would really be appreciated, i am very frustrated with all of this and would just like to get rid of it and move on already too, which is unfortunate because the van was perfect but after this experience I don't think I would like to chance going through it again.

Sorry to hear about your problem. Use the search feature of the forum and type in lemon law and you should get some threads to check through. There was a post recently, so you might also check the new posts tab and check the last three days list. If you put your van info (year, trim, gas/hybrid, etc) in the signature line of the User CP it might help others assist you. Lemon laws vary by state.

When dealing with a large sum of money like a new Pacifica - would definitely look into getting an attorney. I had a situation where I had to take someone to court for about $12,000. I had proof, documentation, historical documents. I even had a consulted an attorney he even agreed it was an open-close kind of case and said I should have no problem winning the case. I represented myself and the other party had an attorney. I literally had the person pegged on paper, in black and white - no question about it. Well, the attorney had to asked for a few days to decide on the case. A couple weeks later I got the verdict in the mail and the judge found in favor of the defendants.

It was a broken sewer line in a house we had just purchased. I called every sewer/rotor-rooter type shop in commuting distance and almost every one had been to the house for sewer problems for the last 15 years. I even had a service ticket that said "broken sewer line at 70 feet from clean-out".

Point is because I didn't have a lawyer - I lost the case. Everybody I talked to about it was blown away with the how much and how strong evidence I had that I lost. I think its because there was some shady lawyer poop that was going on.

I know my Pacifica cost more than $12k. If it were me, I wouldn't make that mistake twice.

Unfortunately a lot of the "techs" today are just parts replacers. They don't do any type of diagnostic work to figure out what's wrong - they just read a code and "throw parts at it" hoping it will solve the problem. Chrysler/Fiat isn't known for their quality either.

After you get this sorted out, you might want to look at Toyota. They seem to build very reliable vehicles - I know many who own them that have gone well over 200,000 miles with just basic maintenance.

And I know a Sienna that blew out the rods at 30,000 miles. Nothing's a guarantee anymore.

Outside of your state lemon law, you'll need to begin with a NCDS claim. This is the dispute process outlined in your owners manual. It's fairly straightforward, and you can present your case yourself or just supply written documentation. Having gone the written route, I'd advise against it and instead ask to present your case to the arbitrators.
